A major drawback in the use of this type of trading system is that, although everyone has a say in what happens in the end, the majority argue, and few people decide what happens too. This means that a large number of people, particularly in the general staff, can be overshadowed and feel that their opinion is not really important. In the worst case scenario, this can lead to serious division and hostility within the group. A study by the Employers` Association of India showed that, out of 109 agreements, “wages” were the most important subject in 96 cases (88%), followed by the derteuer allowance (59 cases), pension benefits (53 cases), bonuses (50 cases) were annual leave, paid leave, work leave, work allocation, overtime , incentives, post allowances, show allowance, tiffin allowance, canteen and medical benefits. Governments should consult with employers` and skilled workers` organizations to determine the minimum benefits and the minimum number of workers needed to make them available, to ensure that the scale of the minimum service does not, in practice, result in the strike becoming ineffective because of its limited effects. Any difference of opinion in determining these minimums should be resolved by an independent body and not by the Ministry of Labour or by the relevant department or (public) company. Question: Why is collective bargaining important to the economy? Collective bargaining covers, on the whole, themes and issues that fall within the terms and conditions of employment. It also looks at the development of dispute resolution procedures between employees and management. Question: Do companies have a responsibility to promote or respect collective bargaining with respect to the principle of “promoting collective bargaining”? To what extent should a company be proactive in promoting the principle? Is it sufficient to negotiate collective agreements when workers demand it? or should a company also encourage collective bargaining between its employees and in its supply chain? The success of collective bargaining lies in the attitude of management and workers, which is in fact incompatible with the spirit of collective bargaining in India.
There are some problems hindering the growth of collective bargaining in India. It is not possible to say whether workers have achieved equal bargaining with employers. But collective bargaining had given a new relationship in which it is difficult for the employer to relinquish the relatively greater collective force. Question: What are the themes that can be covered by collective bargaining? The proper and timely implementation of the treaty is essential to the success of collective bargaining. If a contract is applied in such a way as to reduce or cancel the benefits expected by the parties, it will destroy the fundamental objective of collective bargaining.
